Chapter 4 : Penalties, discount, fees and costs

17. Discount

(1)The discount contemplated in section 17(1)(d) of the Act is set out in paragraph 3 of Schedule 2.

 

(2)The discounted penalty amounts payable in respect of an infringement where payment is made within 32 days after the infringement notice was served, is set out in column 8 of Schedule

 

(3)If a representation contemplated in section 18 of the Act is received by the Authority in accordance  with  section  17(1)(f)(i), and the—
(a)representation is rejected; or
(b)representation on the main charge is allowed and the infringer admits fault on the alternative charge,

the infringer is entitled to the discount contemplated in section 17(1)(d) of the Act if payment of the discounted amount is made within 32 days after the notification of the results of such representation contemplated in regulation 8(1) is deemed to have been served on the infringer in accordance with regulation 35(4).

 

(4)If a representation contemplated in section 18 of the Act and received by the Authority in accordance with section 17(1)(f)(i), is rejected, the infringer who applies for an appeal or review in terms of section 29B of the Act shall be entitled to the discount if payment of the discounted amount is made within 32 days after notice of the outcome of an appeal or review contemplated in regulation 15(6) is deemed to have  been served on the infringer.

 

(5)If an arrangement for payment of the penalty and fees in instalments is made in accordance with regulation 25, such payment must be made in the arranged instalments, in which case the infringer, despite the provisions of this regulation, is not entitled to a discount and the full penalty and applicable fees will be payable.
