| (1) | An application for the payment of any penalty or fees in instalments, as contemplated in section 17(1)(f)(iii) or 18(7)(b)(i) of the Act, must be made on form AARTO 04. |
| (2) | The application contemplated in subregulation (1) must— |
| (a) | be submitted in accordance with regulation 35(1); and |
| (b) | indicate the number of monthly instalments requested which shall be five (5) monthly instalments where the penalty is R2000 or less and ten (10) monthly instalments where the penalty exceeds R2000. |
| (3) | If an application contemplated in subregulation (1) has been submitted to— |
| (a) | an issuing authority, such authority must process the application in accordance with regulations 35(2) and inform the Authority thereof in accordance with regulation 35(5); |
| (b) | the Authority, the Authority must process the election to pay in instalments in accordance with regulation 35(2); and |
| (c) | the Authority must notify the infringer of the outcome of the application on form AARTO 06 and serve it on the infringer in accordance with regulation 35(4) and inform the infringer that the relevant demerit points have been recorded against his or her name in the National Road Traffic Offences Register in respect of the infringement in question. |
| (4) | In the case where points were incurred, notify the infringer on a form similar to AARTO 18 form as shown in Schedule 1 as required by sub-sections 17(3)(c), 17(3)(d), 18(8)(c), 18(8)(d), 19(3)(c) and 19(3)(d) of the Act that the demerit points have been recorded against his or her name in the National Road Traffic Offences Register and the demerit points incurred by him or her to date, together with an indication of number of point left before his or her driving licence, professional driving permit or operator card is suspended or cancelled in accordance with regulation 32 (2). |
| (5) | Where payment is made in instalments, such payment must be made— |
| (a) | in five equal instalments for amounts up to R 2000-00; and |
| (b) | in 10 equal instalments for amounts of more than R 2000-00, and |
each payment must be made monthly on or before the first day of each calendar month in accordance with regulation 24 until full settlement of the outstanding amount has been made.
| (6) | If the infringer fails to pay or makes an insufficient payment of an instalment, the Authority must notify the infringer in accordance with regulation 35(4) on form AARTO 16. |
