Protection of Geographical Indications and Designations of Origin used on Agricultural Products intended for sale in the Republic of South Africa

8. Date of application for registration and priority

(1)In terms of regulation 4, the date of application for the registration as a South African GI or South African designation of origin by a producer or group of producers shall be regarded as the date upon which the Executive Officer receives the first application.

 

(2)In terms of regulation 6, the date of application for registration as a foreign GI or foreign designation of origin, excluding foreign Gls and foreign designations of origin that form part of international agreements, shall be regarded as the date upon which the Executive Officer receives the application.

 

(3)The first application received by the Executive Officer for the registration of a South African GI, a South African designation of origin, a foreign GI or a foreign designation of origin, excluding foreign Gls and foreign designations of origin that form part of international agreements, shall have priority over any subsequent application for registration of an identical GI or designation of origin—
(a)in respect of the same agricultural product; and
(b)having the same or similar geographical origin.
