48. Delegations

(1)In addition to the delegations and assignments which the Minister is specifically authorised by this Act to make, the Minister may delegate any power or duty vested in him or her in terms of this Act excluding the power to declare areas referred to in sections 5, 7, 9 and 11 and the power to make regulations, to—
(a)an official of the Department;
(b)the holder of an office of any other national department, provincial administration or municipality after consultation with the relevant Minister or MEC; or
(c)an official of the NRF.

 

(2)A delegation contemplated in subsection (1)—
(a)must be in writing;
(b)may be made subject to conditions;
(c)does not prevent the exercise of the power or duty by the Minister himself or herself; and
(d)may be withdrawn by the Minister.
