52. General offences and penalties

(1)A person is guilty of an offence if that person—
(a)contravenes or fails to comply with section 20(1);
(b)undertakes a declared activity in contravention of a notice published by the Minister in terms of section 23(1) or a decision taken in terms of section 23(3);
(c)contravenes or fails to comply with a condition prescribed in terms of section 27(2);
(d)contravenes or fails to comply with a national standard or measure prescribed in terms of section 37(1) or any standard incorporated into law in terms of section 37(2);
(e)contravenes any condition imposed in any authorisation or exemption issued in terms of this Act or prescribed in terms of this Act;
(f)hinders or interferes with a management authority or an official, member or staff member of a management authority in the performance of official duties; or
(g)knowingly supplies false information as part of any public participation process conducted in terms of section 42, or in any report submitted in terms of section 25(4)(a); or
(h)falsely professes to be an official, member or staff member of a management authority or the interpreter or assistant of such an official.

 

(2)A person convicted of an offence in terms of subsection (1) is liable on conviction to a fine not exceeding R1 000 000 or to imprisonment for a period not exceeding five years or to both a fine and such imprisonment.
