(1) | Subject to section 42, a public company— |
(a) | that intends to exercise control over any bank; or |
(b) | which is a controlling company, as defined in section 1 of the Companies Act, in respect of any other public company which has applied in terms of section 16 for registration as a bank, |

shall apply to the Authority on the form prescribed for registration as a controlling company in respect of that bank or proposed bank, as the case may be.

(2) | An application referred to in subsection (1) shall be accompanied by such information and documents as may be prescribed. |
(3) | A public company applying in terms of subsection (1) for registration as a controlling company shall submit such additional particulars in connection with its application as the Authority may require. |
