22. Definitions

In this Determination, unless the context indicates otherwise—

 

"agent"

means a person who is authorised to act for, or on behalf of, a child in contractual relations with an employer;

 

"Basic Conditions of Employment Act"

means the Basic Conditions of Employment Act, 1997 (Act 75 of 1997);

 

"call"

means the time spent by a child under the supervision of, or on the premises of the employer, including time spent outside a performance;

 

"child"

means any person younger than 15 years of age;

 

"child minder"

means a person appointed to attend to the child’s needs during call;

 

"Determination"

means the Sectoral Determination for children in the performance of advertising, artistic and cultural activities;

 

"Director-General"

means the Director-General of Labour;

 

"employment"

means the engagement of a child by a natural or legal person to perform any work, regardless of whether the child—

(a)is remunerated or not;
(b)is contracted for a specific period of time or to perform a specific task, or for an indefinite period of time; or
(c)is engaged as an independent contractor.

 

"legal guardian"

means—

(a)a person other than a parent, with parental authority over a child; or
(b)a person responsible for the administration of a child’s estate and who has the capacity to assist or represent the child in legal proceedings or in the performance of juristic acts, and includes a manager of an institution at which the child resides.

 

"Minister"

means the Minister of Labour;

 

"parent"

means a parent with parental authority over a child, including guardianship and custody;

 

"school"

includes any institution for educating, training or giving instruction in any discipline.
