(1)Exclusion: This clause shall not apply to an employee earning an annual wage in excess of the remuneration stipulated by the Minister in the determination made in Regulation 1438 published on 13 November 1998 or in any other determination in substitution thereof.

 

(2)An agreement in writing between an employer and an employee may require or permit the latter to work up to twelve hours in a day, inclusive of the meal intervals required in terms of clause 7(3), without receiving overtime pay.

 

(3)An agreement in terms of subclause (2) may not require or permit an employee to work—
(a)more than 45 ordinary hours of work in any week;
(b)more than ten hours’ overtime in any week; or
(c)on more than five days in any week.
