The following are the four (4) issues that will be deliberated and concluded post the gazette of the AgriBEE Sector Code 9 (1) and once there is a clear scientific and legislative directive on all the four issues, the AgriBEE Sector Code will be amended accordingly through the Minister of Agriculture, Forestry and Fisheries.

 

The issues are:

 

1.The inclusion of the contents of the Local Procurement Accord into the AgriBEE Preferential Procurement Scorecard. The Department of Trade and Industry will give guidance with regard to the revised Preferential Procurement Scorecard;
2.The proposal that all farms that are subject to land claim in terms of Land Restitution should be given an automatic level 4 BEE status or 3 (as described in the Codes of Good Practice);
3.The review of the thresholds will be concluded once the AgriBEE Economic Study has been concluded by the National Agricultural Marketing Council; and
4.Any other amendment pertaining to the B-BBEE Act 53 of 2003 and the Generic Codes of Good Practice by the Department of Trade and Industry will be effected accordingly in the AgriBEE Sector Code.

 

SIGNATORIES TO THE GAZETTE OF THE AgriBEE SECTOR CODE IN TERMS OF SECTION 9(1) OF THE BROAD-BASED BLACK ECONOMIC EMPOWERMENT ACT NO. 53 OF 2003.

Representative organizations of major stakeholders in the Agricultural Sector hereby confirm that we have participated in the process of developing the AgriBEE Sector Code and hereby commit ourselves to the gazette and implementation of the AgriBEE Sector Code in terms of Section 9(1) of the B-BBEE Act No. 53 of 2003.
