13. Amendments and Duration of the ICT Codes

13.1The ICT Codes shall be effective and legally binding from the date of gazette to 31st April 2026 with a midterm five year review on the 31st April 2017 or until amended, substituted or repealed under section 9 of the Act.

 

13.2The process for the amendment of the ICT Codes will follow the process set out in the Generic Codes for the development of Sector Codes. Any amendments to the Generic Codes must result in a review of the ICT Codes for purposes of harmonisation.

 

13.3The Minister of Trade and Industry will review the Generic Codes following the end of the tenth year following the commencement date of the Generic Codes. Despite the aforementioned, annual reviews will take place to monitor the implementation of B-BBEE throughout the economy. If, as a result of such review any changes are made to the Generic Codes, the ICT Codes will also be harmonised with the Generic Codes following the same process set out in 13.2.
