(1) | Subject to the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002), the National Environmental Management Act, 1998 (Act No. 107 of 1998), the National Water Act, 1998 (Act No. 36 of 1998), and the Constitution, the Minister of Minerals and Energy may permit the use of land held under any |
(2) | Before granting any permission in terms of subsection (1) for the use of land held under any reconnaissance permission, exploration, prospecting or mining authorization or permission for the establishment of airports or for landing places for aircraft, the Minister of Minerals and Energy must consult with the Minister and all interested parties. |
