(1) | Disciplinary proceedings initiated against a member of the police service as a result of recommendations of the Secretary or a head of a provincial secretariat in terms of these regulations must be conducted in accordance with the South African Police Service Discipline Regulations. |
(2) | The recommendations contemplated in sub-regulation (1) must be contained in a report submitted to the Minister, in the case of the Civilian Secretariat, or to the MEC in the case of a provincial secretariat and a copy of such report must be submitted to the National Commissioner, and where appropriate, the relevant Provincial Commissioner, as soon as is practicably possible. |
(3) | The duty imposed upon the Secretary or a head of a provincial secretariat under sub-regulation (2) may be delegated, in writing, by the Secretary or a head of a provincial secretariat to a suitable member of the Civilian Secretariat or a provincial secretariat. |
(4) | The National Commissioner or Provincial Commissioner, as the case may be, must ensure that an acknowledge receipt, in writing, of the report referred to in subregulation (2) is provided to the secretary or the head of provincial secretariat, as the case may be, within seven days of receipt of such report. |
