268A. Mandatory Appointment of Secretary

The directors of any public company having a share capital, excluding a share block company as defined in section 1 of the Share Blocks Control Act, 1980 (Act No. 59 of 1980), shall appoint a secretary who is permanently resident in the Republic and who, in the opinion of the directors, has the requisite knowledge and experience to carry out the duties of a secretary of a public company.
