Schedule 3:

 

Diseases

 

In this Schedule the following general concepts have been defined and clarified as set out below.

 

General

 

1.Schedule 3 deals with the List of Occupational Diseases which depicts diseases that are occupational and compensable on the benefits of an explicit presumption referred to in terms of section 66 of the Compensation for Occupational Injuries and Diseases Act, 1993.

 

2.The amended Schedule 3 is issued to align the list of diseases mentioned in the first column of Schedule  of the Compensation for Occupational Injuries and Diseases Act, 1993 with the list of occupational diseases appended to International Labour Organization R194 List of Occupational Diseases Recommendation, 2002.

 

3.The amended Schedule 3 is issued in conformity with section 65(a) and 66 of the Compensation for Occupational Injuries and Diseases Act, 1993.

 

4.The List of Occupational Diseases appended to this amended Schedule 3 shall supersede the list of diseases mentioned in the first column of Schedule 3 in terms of 65(a) of the Compensation for Occupational Injuries and Diseases Act, 1993.

 

5.Work shall be defined as:
-All work involving the handling of and/or exposure to any agent(s) mentioned in the List of Occupational Diseases; and/or
- Any occupation involving the handling of and/or exposure to specified agent/work processes mentioned in the List of Occupational Diseases.

 

6.Work as defined in the amended Schedule 3 shall supersede all previous work(s) mentioned in Schedule 3 and in section 66 of the Compensation for Occupational Injuries and Diseases Act, 1993.

1.1.4Diseases caused by chromium or its toxic compounds
1.1.5Diseases caused by manganese or its toxic compounds
1.1.6Diseases caused by arsenic or its toxic compounds
1.1.7Diseases caused by mercury or its toxic compounds
1.1.8Diseases caused by lead or its toxic compounds
1.1.9Diseases caused by fluorine or its toxic compounds
1.1.10Diseases caused by carbon disulphide
1.1.11Diseases caused by the toxic halogen derivatives of aliphatic or aromatic hydrocarbons
1.1.12Diseases caused by benzene or its toxic homologues
1.1.13Diseases caused by toxic nitro- and amino-derivatives of benzene or its homologues
1.1.14Diseases caused by nitroglycerine or other nitric acid esters
1.1.15Diseases caused by alcohols, glycols or ketones

1.2Diseases caused by physical agents

 

1.2.1Hearing impairment caused by noise
1.2.2Diseases caused by vibration (disorders of muscles, tendons, bones, joints, peripheral blood vessels or peripheral nerves)
1.2.3Diseases caused by work in compressed air / abnormal atmospheric or water pressure
1.2.4Diseases caused by ionizing radiations
1.2.5Diseases caused by extreme temperatures (cold and hot)
1.2.6Diseases caused by ultraviolet radiation

 

1.3Diseases caused by biological agents
1.3.1Infectious or parasitic diseases contracted in an occupation where there is a particular risk of contamination
1.3.2Toxic/inflammatory syndromes (inhalation fever, toxic pneumonitis, organic dust toxic syndrome) associated with exposure to bacterial and fungal contaminants (endotoxin, mycotoxins, (1->3)-B-D-glucans, volatile organic compounds)

 

2.DISEASES BY TARGET ORGAN SYSTEMS

 

2.1Occupational respiratory diseases

 

2.1.1Pneumoconiosis-fibrosis of the parenchyma of the lung caused by fibrogenic dust
2.1.2Pleural thickening caused by asbestos dust exposure
2.1.3Silicotuberculosis
2.1.4Bronchopulmonary diseases caused by hard-metal dust
2.1.5Bronchopulmonary diseases caused by cotton, flax, hemp or sisal dust (byssinosis)
2.1.6Occupational asthma caused by one of the following recognized sensitising agents or irritants inherent to the work process:
2.1.6.1isocyanates
2.1.6.2platinum, nickel, cobalt, vanadium or chromium salts
2.1.6.3hardening agents, including epoxy resins
2.1.6.4acrylic acids or derived acrylates
2.1.6.5soldering or welding fumes 2.1.6.6 substances from animals or insects
2.1.6.7fungi or spores
2.1.6.8proteolytic enzymes
2.1.6.9organic dust
2.1.6.10vapours or fumes of formaldehyde, anhydrides, amines
2.1.6.11latex
2.1.7Extrinsic allergic alveolitis caused by the inhalation of the following organic dusts and chemicals inherent to the work process: moulds, fungal spores or any other allergenic proteinaceous material, 2,4 toluene-di-isocyanates
2.1.8Siderosis
2.1.9Chronic obstructive pulmonary diseases
2.1.10Diseases of the lung caused by aluminium
2.1.11Upper airways disorders caused by recognized sensitising agents or irritants inherent to the work process
2.1.12Diseases caused by chronic or repetitive exposure to products of combustion

 

2.2Occupational skin diseases

 

2.2.1Allergic or irritant contact dermatitis caused by physical, chemical or biological agents
2.2.2Occupational vitiligo

 

2.3Occupational musculo-skeletal disorders

 

2.3.1Musculo-skeletal diseases caused by specific work activities or work environment where particular risk factors are present. Examples of such activities or environment include:
(a)rapid or repetitive motion
(b)forceful exertion
(c)excessive mechanical force concentration
(d)awkward or non-neutral postures
(e)vibration

 

3.        OCCUPATIONAL CANCER

3.1.5Coal tars, coal tar pitches or soots

3.1.9Toxic nitro- and amino-derivatives of benzene or its homologues
3.1.10Ionizing radiations
3.1.11Tar, pitch, bitumen, mineral oil, anthracene, or the compounds, products or residues of these substances
3.1.12Coke oven emissions
3.1.13Compounds of nickel
3.1.14Wood dust
3.1.15Crystalline silica
3.1.16Mycotoxins
3.1.17Arsenic

 

4.OTHER DISEASES

 

4.1        Miners' nystagmus
