2. Application of Act

(1) Subject to the provisions of subsection (2) this Act shall not apply—
(a) to any land which is situated in an urban area;
(b) [Subsection (1)(b) deleted by section 41(1) of Act No. 108 of 1991]
(c) to any land situated within any area declared under section 2 of the Mountain Catchment Areas Act, 1970 (Act No. 63 of 1970), to be a mountain catchment area.

 

(2)
(a) The provisions of this Act relating to weeds and invader plants shall also apply to land which is situated within an urban area.
(b)The provisions of this Act relating to the burning of veld shall not apply to a private forest as defined in section 1 of the Forest Act, 1968 (Act No. 72 of 1968), to which any provision of that Act which relates solely to State forests has been applied under section 2(2) of that Act.

 

(3) The Minister may by regulation declare any plant to be a weed or an invader plant for the purposes of this Act, either throughout the Republic or in one or more areas therein.
