(1) | An employer must, within 21 working days from the date on which a contractor's offer to perform a construction works contract is accepted in writing by the employer, apply on the approved form to the Board for the registration of every project, consisting of a single construction works contract, of which the contract value exceeds a value determined by the Minister by notice in the Gazette. |
(1A) | Despite the values determined in Government Notice No. 692 of 9 June 2004, every project consisting of a single construction works contract— |
(a) | for the public sector of which the value exceeds R200 000.00; or |
(b) | for the private sector and a public entity listed in Schedule 2 of the Public Finance Management Act, 1 of 1999, of which the value exceeds R10 million, |
must be registered in accordance with this Part.

(2) | The Board must, within 30 working days from receipt of the duly completed application in terms of sub-regulation (1), register the project concerned and supply the employer with a receipt of registration. |
(3) | The employer must indicate in the application referred to in sub-regulation (1), whether— |
(a) | the project being registered relates to a project that consists of a series of contracts; or |
(b) | the project being registered relates to a programme, if any; |
(c) | the project relates to a public-private partnership; and |
(d) | that employer acts on behalf of a client. |
(4) | The client that initiated the project concerned must pay the fee as shown in Schedule 2, on— |
(a) | the date of registration of the project; or |
(b) | in advance in relation to a number of projects that are to be registered by that client, for a period agreed on with the Board. |
