10. Reports by committee

1)The committee shall report to the Minister on the result of any investigation made by it in terms of section 8(1).

 

2)If the committee--
a)after an investigation in terms of section 8(1)(a)--
i)is of the opinion that a unfair business practice exists, or was in existence at any time after the date of the notice in terms of section 8(4), or may come into existence;
ii)is not satisfied that that unfair business practice is justified in the public interest; and
iii)has not made an arrangement with the party or parties concerned which has been confirmed by the Minister in terms of section 11(2)(a);
b)(deleted by the Consumer Affairs (Unfair Business Practices) Amendment Act, 2001),

the committee shall in its report recommend to the Minister that such action be taken under section 12(1) as it may consider necessary in the circumstances.

 

3)Every report in terms of this section which in the opinion of the Minister may be made known without detriment to the public interest--
a)shall as soon as practicable be laid upon the Tables of Parliament;
b)may at any time, either before or after it is or was laid upon the Tables of Parliament, be published by the Minister in the Gazette or be made known in any other manner that the Minister may deem expedient.
