1.

The amendment of section 89 by the substitution for subsection (1) of the following subsection:

 

'(1)

The court, other than the court of a regional division, shall have jurisdiction over all offences, except treason, murder, [and] rape and compelled rape as contemplated in sections 3 and 4 of the Criminal Law (Sexual Offences and Related Matters) Amendment Act, 2007, respectively.'.

2.

The substitution for Schedule 2 of the following Schedule:

 

"Schedule 2

Offences in respect of which judicial officers must be assisted by two assessors in terms of section 93ter(2):


1.

Murder.


2.

Rape or compelled rape as contemplated in sections 3 or 4 of the Criminal Law (Sexual Offences and Related Matters) Amendment Act, 2007, respectively.


3.

Robbery, where serious bodily harm has been inflicted on the victim.


4.

Assault, where serious bodily harm has been inflicted on the victim.
