To the extent that this Act conflicts with an obligation of the Republic arising out of any treaty or other form of agreement to which it is a party with one or more other States and which treaty or agreement has been enacted into law in terms of section 231(4) of the Constitution of the Republic of South Africa, 1996 (Act No. 108 of 1996), the requirements of the treaty or agreement prevail.
