37. Provincial peculiarities

(1) To accommodate any specific provincial area or community peculiarities, a Premier may, after consultation with the Minister, any relevant MEC, the provincial house and the PICC, by notice in the Provincial Gazette determine that the provisions of this Act relating to principals, care-givers or traditional surgeons apply to and must be complied with by the persons or bodies indicated in such notice and to the extent specified in such notice.

 

(2) A Premier must inform the Minister, any relevant MEC, the NIOC, the provincial house and the PICC of any determination made in terms of subsection (1).

 

(3) Provincial legislation may determine a higher minimum age than the minimum age provided for in sections 2(4) and 28(2).

 

(4) In the absence of provincial legislation contemplated in subsection (3), a Premier may, after consultation with the Minister, any relevant MEC, the provincial house and the PICC, by notice in the Provincial Gazette determine a higher minimum age than the minimum age provided for in sections 2(4) and 28(2).
