Schedule 2 : Crimes and offences giving rise to unfitness enquiry by court

(Section 32)

 

High treason.
Sedition.
Malicious damage to property.
Entering any premises with the intent to commit an offence under the common law or a statutory provision.
Culpable homicide.
Extortion.

 

1)Any crime or offence –
a)in terms of this Act or the previous Act, in respect of which an accused was not sentenced to a period of imprisonment without the option of a fine;
b)in terms of the Domestic Violence Act, 1998 (Act No. 116 of 1998), in respect of which an accused was not sentenced to a period of imprisonment without the option of a fine;
c)involving violence, sexual abuse or dishonesty, in respect of which an accused was not sentenced to a period of imprisonment without the option of a fine;
d)in terms of the Firearms Control Act, 2000 (Act 60 of 2000), in respect of which an accused was not sentenced to a period of imprisonment without the option of a fine.

 

Any conspiracy, incitement or attempt to commit any offence referred to in this Schedule.
