(1) | The registrar, assistant registrar, sheriff, deputy sheriffs and other officers appointed in terms of section 34 of the Supreme Court Act, 1959, for a provincial division of the Supreme Court shall in respect of any session of or compensation court held within the area of jurisdiction of such division, respectively be the registrar, assistant registrar, sheriff and deputy sheriffs for the court concerned and the other appointed officers referred to in the said section 34 shall be officers in corresponding capacities for such court and shall exercise the powers and perform the functions and duties conferred upon or assigned or entrusted them in terms of the Act and these regulations. |
(2) | Whenever by reason of absence or incapacity the registrar, assistant registrar or sheriff of a compensation court referred to in subregulation (1) is unable to carry out his official duties the officer authorised in terms of section 34(1)(b) of the Supreme Court Act, 1959, to act in the place of the absent or incapacitated officer during such absence or incapacity shall be deemed to be the registrar, assistant registrar or sheriff, as the case may be, of the court concerned and shall exercise the powers and perform the functions and duties conferred upon or assigned or entrusted to the registrar, assistant registrar or sheriff concerned in terms of subregulation (1). |
(3) | Whenever a session of the compensation court is held or resumed in a district other than the one in which the compensation court has its seat, the clerk of the court appointed for that district in terms of section 13 of the Magistrates' Courts Act, 1944 (Act No. 32 of 1944), shall for the duration of that session be the assistant registrar of that compensation court, save for the purposes of regulation 40(6). |
