38. Oath by the President

(1)Judges and magistrates shall, when they are appointed president, be bound to the oath or affirmation which they made in the office of judge or magistrate respectively.

 

(2)

(a)A former judge, former magistrate, advocate or attorney appointed president shall, before he commences his functions, make an oath or affirmation, which shall be signed by him in the form set out below, namely:

I, ……………………………………………………….................................................................

(full name)

do hereby swear/solemnly and sincerely affirm that I will, in my capacity as President of the Compensation Court for the area of jurisdiction of  ......................................................................... (mention division) of the Supreme Court of South Africa, administer justice to all persons alike without fear, favour or prejudice.

(b)Any such oath or affirmation shall be taken or made before a judge or magistrate who shall at the foot thereof endorse a statement of the fact that it was taken or made before him and of the date on which it was so taken or made and his signature [sic] thereto.
