3. Condonation of time limits

(1) On good cause shown, the Chairperson of the Appeal Tribunal may condone late performance of an act in respect of which these regulations prescribe a time limit, other than a time limit that is binding on the Appeal Tribunal itself.

 

(2) The Chairperson of the Appeal Tribunal may have regard to the following:
(a) The nature and extent of the delay;
(b) the reason for the failure to act or make a submission timeously;
(c) the nature and extent of any prejudice in not granting condonation; and
(d) whether it would be in the public interest that the appeal be allowed.
