1. | In these Rules any word or expression to which a meaning has been assigned in the Act shall have the meaning so assigned and unless the context indicates otherwise— |
means the Gas Act, 2001 (Act No. 48 of 2001) including regulations made in terms thereof;
means
(a) | the construction of gas transmission, storage, distribution, liquefaction and re-gasification facilities; |
(b) | the conversion of infrastructure into gas transmission, storage, distribution, liquefaction and re-gasification facilities; |
(c) | the operation of gas transmission, storage, distribution, liquefaction and regasification facilities; or |
(d) | trading in gas. |
means administrative action as defined in section 1 of the Promotion of Administrative Justice Act;
means a permit issued by the Energy Regulator in terms of these Rules;
means a person to whom the Energy Regulator has issued a valid authorisation permit to conduct inspections in terms of section 29(1) of the Act;
means the Broad-Based Black Economic Empowerment Act, 2003 (Act No. 53 of 2003), as amended;
means the National Energy Regulator established in terms section 3 of the National Energy Regulator Act, 2004 (Act No. 40 of 2004);
means any gas transmission, storage, distribution, liquefaction and regasification facility;
means a gas user consuming more than 400 000 gigajoules of gas per annum;
means a holder of a licence issued by the Energy Regulator in terms of the Act;
means the Promotion of Administrative Justice Act, 2000 (Act No. 3 of 2000);
means the Protection of Personal Information Act, 2013 (Act No. 4 of 2013);
means regulations made in terms of section 34(1) of the Act;
means Schedule One to the Agreement Concerning the Mozambican Gas Pipeline between the Government of the Republic of South Africa and Sasol Limited, being the Regulatory Agreement between the Minister of Minerals and Energy, the Minister of Trade and Industry and Sasol Limited;
means the Republic of South Africa.
