33. Dissolution of the Fund

(1)The Fund may be dissolved—
(a)by the Board acting with the concurrence of the Minister:  Provided that the Fund shall not be dissolved unless the dissolution has been agreed to after negotiations as contemplated in section 18(2) have taken place; or
(b)in terms of a court order.

 

(2)If the Fund is dissolved in terms of subsection (1), the Board shall appoint a liquidator.

 

(3)Sections 28 or 29, as the case may be, of the Pension Funds Act, 1956 (Act No. 24 of 1956) shall apply to the dissolution of the Fund and the appointment of the liquidator in terms of subsection (2) shall be subject to the approval of the Registrar of Pension Funds.
