28. Delegation by Minister

1)The Minister may delegate to the Director-General any of his or her powers or assign any of his or her duties conferred or imposed on him or her by this Act.

 

2)Any delegation contemplated in subsection (1)-
a)may be made subject to such conditions as the Minister may determine;
b)must he communicated to the delegatee in writing;
c)may be amended or withdrawn by the Minister in writing; and
d)does not prohibit the Minister from exercising that power or performing that duty.

 

3)The Minister may not delegate the power to-
a)make regulations; or
b)appoint a member of the Board.

 

4)
a)The Minister may issue a directive to the Director-General regarding the delegation contemplated in subsection (1).
b)The Director-General must give effect to the directive contemplated in paragraph (a).
