REQUIREMENTS

a)Proof of the need to employ the requested number of foreigners;
b)A certificate by the Department of Labour confirming—
i)that despite diligent search, the corporate applicant was unable to find suitable citizens or permanent residents to occupy the position available in the corporate entity;
ii)The job description and proposed remuneration in respect of each foreigner;
c)That the salary and benefits of any foreigner employed by the corporate applicant shall not be inferior to the salary and benefits of citizens or permanent residents occupying similar positions in the Republic;
d)a certificate by the Department of Trade and Industry;
e)proof of registration with the—
i)South African Revenue Service;
ii)Unemployment Insurance Fund;
iii)Compensation Fund for Occupational Injuries and Diseases; and
iv)Companies and Intellectual Properties Commission (CIPC), where legally required;

I solemnly declare that I am authorised to make this application and to accept the obligations it involves on behalf of the aforesaid company.

 

 

I declare that the information contained in this application is true and correct and undertake to—

(a)accept full responsibility for the foreigners to be employed;
(b)Ensure that the passport of the foreigner is valid at all times;
(c)inform the Department if any such foreigner is no longer in compliance with the Act, no longer employed by the company or employed is in a different capacity, prior to occupying such different capacity;
(d)ensure that such foreigner departs from the Republic upon completion of his or her contract of employment.

 

 

I declare that none of the foreigners to be employed are not presently in the Republic and are not prohibited persons in terms of the Act.

 

 

I understand that the corporate visa issued to me may be terminated in case of breach of this undertaking and any other conditions not complied with.
