7. Assessment of fines and penalties

1)In the assessment of any penalty in terms of section 5 , the court shall take into account any award previously made under section 6 which arises from the same cause.

 

2)In the assessment of any award under section 6, the court shall take into account any penalty previously imposed in terms of section 5 which arises from the same cause.
