Trade unions may opt for either one of the following mechanisms, in each case deductions of trade union subscriptions may be authorized only by the affected employee, in writing:
(a) |
(i) | Each trade union shall be entitled to approach each employer in the Industry direct for the purpose of establishing stop-order facilities for the deduction of trade union subscriptions. |
OR
(b) |
(i) | Every employer shall deduct the Trade Union Subscription Amount (as amended by the Trade Unions from time to time) from an employee who is a member of a registered trade union and for whom wages are prescribed in clauses 9 of this Agreement. |
(ii) | An employer shall pay the amounts deducted by him in terms of paragraph (b) (i) to the Council within the period determined by the Council. |
(iii) | Each month the Council shall pay over to the trade unions all moneys so collected by the employers in terms of paragraph (b) (ii). |
(c) Collective Bargaining Levy
(i) | All employees that are not members of a Trade union that is a party to the Council shall pay an annual amount of R75, to be deducted from their annual pay-out provided that the employee has R500 or more available in his or her Holiday and Bonus Fund credit. |
(ii) | All employees that are not members of a Trade Union that is a party to the Council, already active in the industry or starting in the industry from the date of publication of this agreement until 31 October 2016, will be liable to pay this fee. |
