9. Jurisdiction to Arbitrate

1)The commissioner appointed to arbitrate the dispute may only arbitrate the dispute if the Commission has jurisdiction to arbitrate the dispute.

 

2)If at any stage during the arbitration proceedings it becomes apparent that there is a jurisdictional issue which has not been determined, the commissioner must require the referring party to prove that the Commission has the necessary jurisdiction to resolve the dispute.
