1) | The commissioner appointed to arbitrate the dispute may only arbitrate the dispute if the Commission has jurisdiction to arbitrate the dispute. |
2) | If at any stage during the arbitration proceedings it becomes apparent that there is a jurisdictional issue which has not been determined, the commissioner must require the referring party to prove that the Commission has the necessary jurisdiction to resolve the dispute. |
