31. Procedures for the Negotiation of Agreements and Settlement of Disputes

(1)This Bargaining Council shall, within the undertaking sector, trade or occupation and in the area in respect of which it has been registered, endeavour, by the negotiation of agreements or otherwise, to prevent disputes from arising, and to settle disputes that have arisen or may arise between employers or employers’ organisations and employees or trade unions, and take such steps as it may think expedient to bring about the regulation or settlement of matters of mutual interest to employers or employers’ organisations and employees or trade unions. Parties agree that once a certificate of non-resolution is issued in terms of Section 135 of the Act, it will be peremptory to approach the CCMA in respect of Section 150(2).

 

(2)No strike certificate may be issued until and unless picketing rules have been agreed upon as envisaged by Section 69 of the Labour Relations Act. No party will embark on any form of industrial action unless and until all parties have concluded an agreement on picketing rules.

 

(3)Should the Section 150 facilitated process fail parties agree to approach the CCMA on an expedited basis in terms of Section 150A of the Labour Relations Act.

 

(4)All sector negotiations must be initiated and processed in terms of the Council Constitution and Clause 34 of this Agreement.

 

(5)For the purposes of complying with the Act, the Council shall follow the procedures set out in the Metal and Engineering Industries Bargaining Council Dispute Resolution Agreement.
