14. Sick Leave

1.“Sick leave cycle” means the period of 36 months" employment with the same employer and/or the same establishment immediately following:—
(a)an employee"s commencement of employment;
(b)the completion of that employee"s previous sick leave cycle.

 

2.An employee who falls sick may be absent from work for up to 36 working days during a period of 36 consecutive months. However, during the first six months of employment an employee is entitled to one day"s sick leave for every 26 days worked.

 

3.An employer must pay an employer must pay an employee the employee"s basic daily wage for each day that the employee is entitled to paid sick leave.

 

4.An employer is not required to pay sick leave:—
(a)to an employee if they are both contributing to the Hairdressing Trade Sick Pay Fund referred to in clause 36;
(b)to an employee who has been absent from work for longer than two days and has not produced a medical certificate stating the nature and duration of the sickness;
(c)to a casual employee.
