Marine Pollution (Prevention of Pollution from Ships) Act, 1986 (Act No. 2 of 1986)

In these regulations—

"mile"

means an international nautical mile or a distance of 1 852 metres;

"operational wastes"

includes all maintenance wastes, cargo-associated wastes and cargo residues except residues or wastes from substances which are defined or listed in other Annexes to the present Convention;

"plastics"

includes, but is not limited to, synthetic ropes, synthetic fishing nets and plastic garbage bags;

"required standard"

in relation to comminuted or ground garbage, means garbage comminuted or ground sufficiently finely to be capable of passing through a screen with openings no greater than 25 millimetres;

"sea"

includes any estuary or arm of the sea;

"small vessel"

means a vessel of less than 25 gross tons and of more than three metres in length;

"Special Area"

shall also include any area declared by the Director-General: Transport in a Marine Notice as from a given date to be a Special Area for the purposes of Annex V to the Convention;

"South African ship"

means a ship—

(a)        registered in the Republic in terms of the Merchant Shipping Act, 1951 (Act No. 57 of 1951) or deemed to be so registered;

(b)        licensed in terms of section 68 of the Merchant Shipping Act, 1951 (Act No. 57 of 1951) or deemed to be so licensed.
