(1) | Whenever an appeal to a Court of Survey lies in terms of section two hundred and seventy-four of the Act and has been duly noted the Minister shall, subject to the provisions of section two hundred and eighty-two of the Act, convene a Court of Survey to hear the appeal, and shall appoint a magistrate to be the presiding officer thereof and two or four other persons to be members thereof. |
(2) | The members, other than the presiding officer, shall be selected from the current list framed in terms of regulation 3, unless by reason of the special nature of the investigation it appears to the Minister expedient to appoint as a member a person whose name does not appear on that list. |
