40. Inspection etc. of Convention ships not registered or licensed in Republic

When considering whether a Convention ship that is neither registered nor licensed in the Republic complies with the requirements of these regulations, a proper officer or a surveyor, as the case may be, need not satisfy himself or herself in relation to—

(a)regulation 6(1)(a), if the equipment is of a type approved by the competent maritime authority of the State whose flag the ship is entitled to fly and that State is a Convention State; or
(b)subregulation 6(1)(c), if the ship is entitled to fly the flag of a Convention State.
