10. Offences and Penalties

(1) A person is guilty of an offence if that person—
(a) fails to comply with Regulations 8(1); 8(2); 8(3) and 8(4); or
(b) provides incorrect, false or misleading information in any form, including in any document submitted in terms of these Regulations to a competent authority or omits information that may have an influence on the outcome of a recommendation of a fine committee or determination of the competent authority.

 

(2) A person convicted of an offence in terms of these Regulations is liable to a fine not exceeding R5 million or to imprisonment for a period not exceeding 5 years, and in the case of a second or subsequent conviction to a fine not exceeding R10 million or to imprisonment for a period not exceeding 10 years, and both instances to both such fine and such imprisonment.
