National Environmental Management Act, 1998 (Act No. 107 of 1998)

When considering an application the competent authority must have regard to section 24O and 24(4) of the Act, the need for and desirability of the undertaking of the proposed activity, the requirements of these Regulations, any protocol or minimum information requirements relevant to the application as identified and gazetted by the Minister in a government notice or any relevant published in terms of section 24J of the Act.
