National Railway Safety Regulator Act, 2002 (Act No. 16 of 2002)Chapter 9 : Appeal and Dispute Resolution43. Appeal to chief executive officer against decision of railway safety inspector |
(1) | A person whose rights are adversely affected by a decision of a railway safety inspector in the exercise of any power or performance of any duty in terms of this Act, may appeal against that decision to the chief executive officer. |
(2) | Such appeal must— |
(a) | be lodged within 60 days from the date on which that decision was made known by the railway safety inspector or such later date as the chief executive officer permits; |
(b) | set out the grounds of the appeal. |
(3) | After considering the grounds of appeal and the railway safety inspector’s reasons for the decision. the chief executive officer must within the prescribed specified time— |
(a) | confirm, set aside or vary the decision; or |
(b) | substitute the decision of the railway safety inspector with the decision of the chief executive officer. |
