Occupational Health and Safety Act, 1993 (Act No. 85 of 1993) Explosives Regulations, 20029. Design, construction and manufacture |
(1) | No employer shall use or require or permit the use of any building, installation, room, machine or equipment unless— |
(a) | it has been designed and constructed in accordance with health and safety standards incorporated in these regulations in terms of section 44 of the Act |
(b) | it has been approved by an approved inspection authority contemplated in regulation 18 or any foreign inspection authority recognised by the chief inspector of occupational health and safety and |
(c) | the employer, self-employed person or user is in possession of a certificate issued by the manufacturer of the machines or equipment: Provided that such certificate shall be countersigned by an approved inspection authority. |
