32. Regulations

(1)The Minister must make regulations regarding any matter that must be prescribed in terms of this Act and may subject to subsection (2) make regulations regarding—
(a)any matter that may be prescribed in terms of this Act;
(b)offences relating to anything that must or may be done or is prohibited in terms of any regulation made under this section;
(c)uniform norms and standards for service delivery;
(d)any other matter which it is necessary to prescribe for the proper administration or implementation of this Act.

 

(2)The Minister must make regulations with the concurrence of the Minister of Finance if the regulations apply to—
(a)the application for and payment of social assistance;

(b)requirements or conditions in respect of eligibility for grants;
(c)the repayment of amounts overpaid in respect of grants;
(d) additional requirements or conditions in respect of a payment contemplated in section 12A; and
(e) differentiation on the basis of need between beneficiaries of social grants as contemplated in section 12A(2).

(3) The Minister, with the concurrence of the Minister of Finance—
(a) must determine amounts payable in respect of social assistance; and
(b) may determine additional payments linked to a social grant, by notice in the Gazette.
