Condonation of late lodging of appeal |
(1) | The Independent Tribunal may, upon application for condonation by persons contemplated in regulation 14(1), condone an application for appeal lodged after a period of 90 days, upon good cause shown. |
(2) | In deciding whether good cause has been shown for condonation of a late application for an appeal, the Independent Tribunal must take the following factors into account: |
(a) | the reason for the delay; |
(b) | whether it is in the interest of justice that condonation be granted; and |
(c) | if there are reasonable prospects of success. |
(3) | An application contemplated in subregulation (1) must be in a form similar to Form 4 in Annexure A to these regulations. |
