2. Continuation of tariffs in force at effective date

(1) Despite section 11—
(a) a tariff or similar method of price regulation in effect immediately, before the effective date, in terms of any law in respect of a transport facility or service remains in effect as if it had been a price control determined and published in terms of section 11, until the date on which the Regulator first determines and publishes a new price control applicable to that facility or service, subject to sub-item (2); and
(b) an agreement of the type contemplated in section 11(9)(c), that was in effect immediately before the effective date, remains in effect as if it had been approved in terms of this Act, until the date on which the Regulator first determines and publishes a new price control applicable to the relevant facility or service.

 

(2) A pre-existing tariff or similar method of price regulation that remains in effect in terms of sub-item (1) may be reviewed in the manner provided for in section 11.

 

(3) Despite sub-items (1) and (2), a tariff or similar method of price regulation and review mechanisms in effect immediately before the effective date, in terms of—
(a) an agreement contemplated in section (1) of The South African National Roads Agency Limited and National Roads Act, 1998 (Act No. 7 of 1998), or
(b) an agreement or a licence contemplated in sections 56 and 57, respectively, of the National Ports Act, that was concluded before the effective date, remain in effect for the remaining period of that agreement or licence, as the case may be.
