7. Jurisdiction of Court

(1) Subject to the Constitution, and except where this Act provides otherwise, the Court and the Magistrate’s Court within whose area of jurisdiction the land forming the subject matter before that court is situated, have jurisdiction in respect of all matters that in terms of this Act or in terms of any other law are to be determined by the Court or the Magistrate’s Court.

 

(2) The Court has jurisdiction in the area of jurisdiction of each Division of the High Court.

 

(3) The Minister, after consultation with the Chief Justice for the purposes of adjudicating land disputes, by notice in the Gazette
(a) may define a specific area of jurisdiction of the Court, if the need so arises;
(b) may increase or reduce the area of jurisdiction of the Court referred to in paragraph (a), when necessary to do so;
(c) must appoint one or more places within the area of jurisdiction of the Court for the holding of sittings of the Court, other than the seat of each Division of the High Court, to make the Court accessible to the people; and
(d) may withdraw or vary any notice made under this subsection.
