| (1) | The Minister may delegate to the Commissioner, a Deputy Commissioner or any official any function or power conferred, or duty imposed, on the Minister that is permitted to be delegated: Provided that any delegation to a Deputy Commissioner or any official must be made after consultation with the Commissioner. |
| (2) | The Minister may not delegate a power referred to in sections 14(1), 14(4), 23(2), 26, 27(4), 27(5)(b), 30, 31(b), 36, 38(2) and 39(2). |
| (3) | Any delegation in terms of subsection (1)— |
| (a) | is subject to the conditions that the Minister may determine; |
| (b) | must be in writing; |
| (c) | does not prevent the Minister from exercising that power or performing that duty; and |
| (d) | may at any time be withdrawn in writing by the Minister. |
