24. Variation or Rescission of Arbitration Awards or Rulings

1)An application for the variation or rescission of an arbitration award or ruling must comply with the provisions of rule 19.

 

2)The application must be made within 10 days of the date on which the applicant became aware of-
a)the arbitration award or ruling; or
b)a mistake common to the parties to the proceedings.

 

3)The commissioner who issued the arbitration award or ruling must hear the application for variation/rescission in terms of section 144 of the Act, provided that the Commission may, on good cause shown, appoint any commissioner to hear the application.
