35. Codes of Good Practice

35.1. Any party to the Council may submit a code of good practice issued by the Minister of Labour in terms of the Basic Conditions of Employment Act of 1997 as amended, to the Secretary for consideration by the Executive Committee of the Council.

 

35.2. The Executive Committee of the Council shall consult with the respective chambers within its structure before—
35.2.1. endorsing the code of good practice issued by the Minister of Labour for the fishing industry; or
35.2.2. change any code of good practice issued by the Minister of Labour due to the requirements of the fishing industry; or
35.2.3. replace any code of good practice issued by the Minister of Labour due to the requirements of the fishing industry.

 

35.3. Any code of good fishing industry practice shall be annexed hereto and form part of this agreement, once issued by the Council's Executive.

 

35.4. Any person interpreting or applying this agreement must take into account relevant code of good fishing industry practice.

 

35.5. A code of good fishing industry practice may provide that the code in question must be taken into account in applying or interpreting any employment law.
