3. Application of rules

(1) These rules apply to arbitration under sections 19(1) and 33(3) of the Act.

 

(2) If a situation arises which is not provided for in these rules or the Act or the Arbitration Act, the arbitrator must hear the parties' views and then—
(a) deal with it in a way which is effective and fair to the parties; or
(b) if he or she so decides, ask the judge for a direction.
