45. Permission for immobilisation, lay-up, stopping or anchoring within territorial waters or internal waters outside any harbour or fishing harbour

(1) An initial charge of R 8 542, thereafter a charge of R 1 425 per hour or part thereof, are payable for the evaluation and approval of a request to immobilise or layup within territorial waters or internal waters, other than a ship that is in vis major or distress.

 

(2) An initial charge of R 8 542, thereafter a charge of R 1 425 per hour or part thereof, are payable for the evaluation and approval of a request to stop or anchor a ship for repairs within territorial waters or internal waters, other than a ship that is in vis major or distress.

 

(3) An initial charge of R 8 542, thereafter a charge of R 1 425 per hour or part thereof, are payable for the evaluation and approval of a request to anchor a ship outside a harbour within territorial waters or internal waters, other than a ship that is in vis major or distress.

 

(4) Subject to subregulation (1), (2) and (3), a charge of R 1 425 per day or part thereof is payable for ships remaining immobilised, laid-up, stopped or at anchor for more than 7 days within territorial waters or internal waters, unless by prior agreement a variation or waiver [Determination 71] is in effect.

 

(5) In addition, levies are payable as per the Determination of levies regulations, as amended.
