48. Council functions and procedures

(1) The Council considers and determines—
(a)referrals of complaints against regulated entities, in terms of section 16;
(b) referrals of consent agreements in terms of section 19; and
(c) appeals or applications for review in terms of section 22 of any certificate, notice, decision, determination or ruling of the Regulator.

 

(2) The Council must conduct a hearing, subject to its rules, into every matter referred to it in terms of this Act, and publish its decisions in the prescribed manner and form.

 

(3) The Chairperson of the Council must manage the caseload of the Council, and must convene a hearing before at least three of the members of the Council to consider any matter, and must—
(a) ensure that at least one member of the panel is a person who has legal training and experience; and
(b) designate a member of the panel to preside over the proceedings.

 

(4) The Chairperson of the Panel or a member designated by the chairperson, on application by an interested person, may determine whether a decision by the Regulator is to be suspended pending the outcome of the Council’s proceeding on the matter, as contemplated in section 22(4).
